Retórica y derecho en las Declamaciones Menores quintilianeas : decl. min. 308 y revocación del testamento

Abstract

Se analiza de forma resumida la Declamación Menor 308 prestando atención a las leyes sobre las que se construye el discurso y a los argumentos utilizados en él. Se comparan estos elementos con las normas del derecho romano y con el razonamiento jurisprudencial sobre la noción de testamento y la eficacia de su revocación. De la comparación resultan interesantes paralelismos.Minor Declamatio 308 is briefly presented in this paper paying special attention to the laws which the speech is constructed according to, as well as to the arguments mainly used in it. These elements are compared with the rules of Roman Law and with the jurists’ reasoning on the notion of will and the effectiveness of its revocation. Interesting parallels emerge from this comparison.
