Abstract
Este trabajo analiza el alcance de la actuación de las comisiones de investigación y la tutela de los derechos fundamentales de los comparecientes y las personas investigadas. En concreto, esta cuestión será abordada a la luz de lo decidido por el Tribunal Constitucional en la STC 133/2018, en la que resuelve un recurso de amparo interpuesto por un compareciente anteuna comisión de investigación contra varios acuerdos parlamentarios, entre ellos, el dictamen de la comisión de investigación, en cuyas conclusiones se le declara responsable político de los hechos investigados. El Tribunal Constitucional reconoce que el Parlamento ha lesionado el derecho alhonor del recurrente.El artículo se centra en las tres cuestiones más relevantes planteadas en la sentencia: la faceta del recurso de amparo parlamentario del art. 42 LOTC como remedio efectivo para tutelar los derechos fundamentales de los sujetos ajenos a la institución parlamentaria; el problema sobre la delimitación del objeto del recurso como consecuencia de la interpretación de la noción de firmeza del acto parlamentario sostenida por el Tribunal; y la aplicación de la doctrina de la dimensión extraprocesal de la presunción de inocencia al ámbito de las comisiones parlamentarias de investigación
This paper analyzes the scope of parliamentary committees of inquiry and the protection of the fundamental rights of those appearing and persons under investigation. Specifically, this issue will be analyzed in the light of the Constitutional Court’s judgment 133/2018, in which the Court resolved an appeal filed by a person appearing before an inquiry committee against several parliamentary agreements, among others, the conclusions adopted by the inquiry committee, which states him politically responsible for the facts investigated. The Constitutional Court recognizes that the Chamber has violated the appellant’s right to honor. The article focuses on the three most remarkable issues raised in this constitutional judgment: the role of the specific appeal of the art.42 LOTC as an effective remedy to protect the fundamental rights of the persons outside the Parliament; the problem regarding the delimitation of the object of the appeal, due to the interpretation of the notion of firmness of the parliamentary act, held by the Court; and the extension of the external dimension of the presumption of innocence doctrine to parliamentary investigation commissions.
