Separação de poderes, “judicial activism” e “judicial restraint” nos programas de ajustamento : Portugal versus Irlanda

Abstract

A necessidade de assistência financeira por países da Zona Euro levou à existência de uma nova realidade, os Programas de Assistência da chamada Troika: FMI; Comissão Europeia e BCE. Foi o que aconteceu com Portugal e Irlanda. Partindo da separação de poderes e da relação entre o legislativo e o judicial, tendo presentes os conceitos de "judicial activism" e "judicial restraint", analisa-se a realidade pré-existente, as medidas aplicadas e o respectivo contexto, em Portugal e na Irlanda. Para tal escolheu-se uma política pública concreta: as remunerações dos funcionários públicos. Existindo maior intervenção do poder judicial em Portugal, colocaram-se três hipóteses justificativas de tal facto: maior intensidade das medidas em Portugal do que na Irlanda; atitude mais "activista" dos juízes portugueses; diferenças de arquitectura institucional. Da investigação conclui-se que as diferenças na arquitectura e desempenho institucional contribuíram decisivamente para a existência de distintos contextos de aplicação dos programas e, consequentemente, para diferenças na sua concretização. Não tanto pela atitude dos protagonistas, mas pelo desenho institucional dos sistemas. Poderá também ter contribuído para um maior "ativismo judicial" em Portugal a intensidade das medidas ter sido ligeiramente superior. Quanto à natureza relativamente mais "ativista" dos juízes portugueses, não foi possível analisar essa hipótese dada a não intervenção dos juízes irlandeses.

The need for financial assistance by Eurozone countries has led to the existence of a new reality, the Assistance Programs by the Troika: IMF; European Commission and ECB. This is what happened with Portugal and Ireland. Taking into account the separation of powers and the relationship between the legislative and the judicial, and considering the concepts of "judicial activism" and "judicial restraint", this research analyzes the pre-existing reality, the applied measures and their context, both in Portugal and in Ireland. For this purpose, a specific public policy was chosen: the remuneration of civil servants. As to the greater intervention of the judiciary in Portugal, three hypotheses are presented: a greater intensity of measures in Portugal than in Ireland; a more "activist" attitude of the Portuguese judges; differences in the institutional architecture. The research concludes that differences in architecture and institutional performance have greatly contributed to the existence of distinctive contexts of application of the programs and, consequently, to differences in their implementation. Not so much for attitudinal issues of the protagonists, but for the institutional design of the systems. The higher "judicial activism" in Portugal can also be explained by a slighty greater intensity of the measures taken in Portugal.
