The duties of insolvency practitioners have been a hot-button issue in recent times, with several cases brought by creditors against administrators and liquida- tors, seeking to challenge the conduct of the insolvency proceedings. The long-running case ofMacks v Viscariello1 was described by the court as a “campaign of attrition”, which involved several sets of parallel proceedings involving multiple parties connected with the collapse of a chain of linen retailers more than 15 years ago. The recent appeal in this matter2 has considered a number of important issues relating to the duties of administrators and liquidators which provide useful guidance for insol- vency practitioners and their advisors.
