In 2010 the NSW Minister for Fair Trading (Hon Virginia Judge MP) established an independent Review Advisory committee to investigate public interest concerns about the installation of high-front guttering into homes in NSW. The Committee investigated whether or not high fronted guttering installed in residential dwellings in New South Wales posed a systemic problem in terms of compliance with regulations - specifically the Building Code of Australia (BCA). I chaired and lead the review. The issue, which can be situated within the field of building science and building technique, was significant because if a systemic problem was proven to exist, hundreds of thousands of dwellings constructed over the last 20 years could involve issues pertaining to property damage, occupantâs health, building durability, regulatory non-conformance. The review was to assist in the development of policy, regulatory clarity and responsibility on the presence or not, of a systemic failure. Multiple data sources were gathered and analysed including: regulatory legislation; the ability of prescriptive building solutions to meet Building Code of Australia performance requirements; installer knowledge of performance requirements; and the availability of measurable and verifiable performance data on key devices within gutter design. A report addressing the above issues, including a set of recommendations, was submitted and approved by the minister and publicly released by the State Government in July 2011. The report's impact on public policy is evident in both the way the Government has approached and requested regulatory change, and in advising the public on how to address issues relating to high front gutters (see web links).
