Los modos de la obligación de responder por un daño han mutado desde un esquema sancionatorio, motivado por la intención de disciplinar al responsable (la responsabilidad civil) hacia una perspectiva resarcitoria focalizada en la víctima y su expectativa de reparación integral (el Derecho de Daños). Hoy, la antijuridicidad ha perdido su carácter de presupuesto del deber de indemnizar y el daño se sitúa en el centro de todo el sistema jurídico, fundado en la expectativa de resarcimiento. La sustitución ontológica de las herramientas disponibles para hacer justicia –v.gr., objetivización de los factores de atribución, consideración de las necesidades futuras del dañado, como un daño en sí mismas– y el nuevo contenido de aquello que el hacer justicia significa (la minimización de las consecuencias disvaliosas del daño) han alterado profundamente todas las incumbencias jurídicas reflejándose, de forma prioritaria y por razón de su objeto más elemental –el riesgo, la presencia de un daño en expectativa–, en el Derecho de Seguros. En este proceso, nuestra materia adopta nuevos puntos de vista que obligan al forzamiento conceptual de sus instituciones más tradicionales –por ejemplo, el seguro de responsabilidad civil surgido en épocas en que el deber de responder agotaba por sí mismo, toda imposición de juridicidad en la determinación de un resarcimiento– o a la sustitución de sus esquemas habituales por otros más adecuados a la actual noción común de Justicia vigente. Nosotros nos inclinamos, claramente, por la segunda de estas opciones.
Abstract
The modalities of obligation entailed by civil liability have changed from a sanction- oriented structure motivated by the intention to discipline the wrongdoer (civil liability) to a repairing perspective focused on the victim and her expectation of integral redress (the Law of Damages). Today, anti-juridical behavior has lost its feature of being an assumption to indemnify, and damage is the center of the juridical system, based on the expectation of redress. The ontologic substitution of tools available to administer justice, e.g.: making factors of attribution objective, consideration of futures needs of the victim of the wrong as damage in themselves, and the new contents of what justice administration means (minimization of non-valuable consequences of damages) have profoundly changed all legal implications and the presence of expected damages, being reflected in the Insurance Law due to its most important object which is the risk. In this process, our subject matter adopts new viewpoints that require either putting the most traditional institutions into concepts –for example, the civil liability insurance policy– originated in times in which the duty to repair or the duty of redress exhausted by themselves any legal imposition when determining redress or the substitution of its customary structures for ones that are much more adequate to the common current notion of Justice. We tend to clearly favor the second of these options.
