Safety of the information contained in medical registers
Abstract
Polski system informacji medycznej, będący orężem w walce o zdrowie pacjenta, podlega ochronie prawnej. Czy jednak obowiązek ten wykonywany jest w sposób właściwy? Czy poprzez decentralizację władzy w systemie ochrony zdrowia, informacja medyczna nie uległa znacznej dekoncentracji, stając się podatną na możliwość zafałszowania?
W Polsce istnieje ok. 32 rejestrów medycznych prowadzonych na podstawie przepisów prawa. Brak głównego rejestru medycznego – z jednej strony – zapewnia bezpieczeństwo użytkowników systemu ochrony zdrowia w Polsce: pacjentów, świadczeniodawców, ubezpieczycieli etc., z drugiej jednak – stwarza niebezpieczeństwo fałszowania informacji medycznej. W pracy dokonano próby oceny bezpieczeństwa informacji zawartych w rejestrach medycznych na podstawie analizy aktów prawnych, koncepcji, strategii, ekspertyz i projektów związanych z informacją w systemie ochrony zdrowia, zwracając szczególną uwagę na Centralny Rejestr Lekarzy i Lekarzy Dentystów Rzeczypospolitej Polskiej. Materię tego rejestru określa akt prawny w randze ustawy, co stanowi kolejny krok w procesie regulowania stosunków społecznych i gospodarczych związanych z przekazywaniem i przetwarzaniem informacji.
In Poland, the medical information system as an important tool in the overall patient health care system is protected by law. But is that system and the information stored in it properly protected? And has the de-centralisation of the main authorities in the health care system contributed to the de-concentration of the information making it possible to falsify the data? There are thirty two medical registers in Poland and the manner in which they are kept is regulated by law. The fact that there exist more, not just one, registers ensures, on the one hand, the safety of the information about the users of the health care system, but it creates, on the other hand, a danger that medical data may be falsified. The author attempts to assess the safety of the data stored in medical registers, based on the analysis of the existing laws, conceptions, strategies, expertise and projects concerning information in the health care system. Among them the Central Register of Medical and Dental Practitioners of the Republic of Poland is particularly noteworthy. Its contents is regulated by the statute and significantly contributes to the regulation of the social and economic relations that are being established in the transmission of information and data processing.
