Abstract

En las últimas décadas se ha observado un incremento de conductas delictivas en mujeres, lo cual obedece a un cambio social más que individual, y que a su vez corresponde a un proceso socio-histórico, cultural y político enmarcado en la perspectiva socioconstruccionista, la concepción de poder de Michael Foucault y las diferentes contribuciones feministas. Los análisis feministas apuntan a la existencia de un orden androcéntrico y patriarcal que mediante las prácticas de subjetivación, constituyen la identidad de los sujetos. Desde esta posición se consideró que la realidad social está construida por la acción de las personas y que por tanto hay que aproximarse a la comprensión de esta realidad. Objetivos. Con el fin de responder interrogante: ¿por qué las mujeres delinquen y porqué desisten del delito?, se estableció como objetivo principal analizar cuáles son las prácticas sociales que promueven el delito y el desistimiento e identificar la forma en la que dichas prácticas se producen. Método. Estudio de corte cualitativo, enmarcado en las perspectivas socioconstruccionistas y de género. Se entrevistaron 94 mujeres en 4 países: España, Uruguay, México y Colombia, de las cuales 81 estaban en la cárcel en el momento de la entrevista y 13 habían estado en la prisión en algún momento de sus vidas. Se analizaron sus relatos de vida a través del Atlas.ti software. Resultados. Del análisis de contenido temático se hallaron cuatro categorías principales: vínculos afectivos, violencia, redes sociales y desistimiento. Se encontró que haber sufrido violencia de género puede ser un factor explicativo del delito, los vínculos afectivos y las redes sociales pueden ser factores movilizadores hacia el delito y hacia el desistimiento del mismo. El desistimiento está dado por la interacción entre la obligación/responsabilidad de las acciones, la libertad de construirse como sujeto y el ayudar a otros. Conclusiones. Los hallazgos sugieren que las mujeres han estado encarceladas desde antes de entrar a la prisión, como víctimas de la violencia de género y conducidas por vínculos afectivos relevantes en un sistema patriarcal; caen en la cárcel escapando de una relación de maltrato, y en esta huida se orientan al delito. La clave del desistimiento está en la igualdad de género, donde hombres y mujeres tengan las mismas responsabilidades frente al cuidado del otro.


In recent decades there has been an increase on criminal behavior in women, which is due to social rather than individual change, corresponding to a socio-historical, cultural, and political process framed in the socioconstructionist perspective, the conception of power of Michel Foucault, and the different feminist contributions. Feminist analysis point to the existence of an androcentric and patriarchal order that, through the practices of subjectivation, constitute the identity of the subjects. Each subject is the correlate of their own practices of subjectivation, therefore, whenever there are new practices that create the conditions of possibility for transformation through the rules and norms that govern the situation, new forms of subjectivationthat transform people, are generated. This establishes the importance of retrieving the narratives of the women participating in the study, with the aim of knowing these forms of subjectivation. From this position it was considered that the social reality is constructed by the action of the people and that therefore we must approach the understanding of this reality. Objectives. In order to respond to the question mark: "Why do women commit crimes and why do they give up crime?.", The main objective was to analyze the social practices that promote crime and withdrawal, and to identify the way in which these practices take place. Method. Qualitative study, framed in the socioconstructionist and gender perspectives. 94 women were interviewed in 4 countries: Spain, Uruguay, Mexico and Colombia, of which 81 were in prison at the time of the interview, and 13 had been in prison at some point of their lives. Their life stories were analyzed through Atlas.ti software. Results. From the analysis of the thematic content there were found four main categories: Affective Bonds, Violence, Social Networks and Withdrawal. It was found that having suffered gender violence can be an explanatory factor of the crime, the affective bonds and the social networks can be mobilizing factors towards the crime and towards the abandonment of the same. The withdrawal is given by the interaction between the obligation / responsibility of actions, the freedom to build herself as a subject and to help others Conclusions. The findings suggest that women have been incarcerated before they enter prison, as victims of gender-based violence and driven by relevant affective bonds in a patriarchal system; they fall into prison escaping from an abusive relationship, and in this escape they are oriented to the crime. The key to the withdrawal is gender equality, where men and women have the same responsibilities in the care of the other.
