Holding, Findings, and Matters of Law
The Court, after extensive in camera review of the classified materials and public evidence, “finds that making any particularized determination on standing in order to continue the litigation may imperil the national security.” 2109 U.S. Dist. LEXIS 217140, at *40. The Court addresses this finding in an a classified order. Id. The Court further dismisses the action based on assertion of the state secrets privilege. Id. at 50.
