Abstract
The consent form signed by artificial heart patient Barney Clark is analyzed and found to be poorly designed, incomplete, inconsistent, and confusing. Its most serious flaw is the absence of a designated proxy to act for Clark in further treatment decisions should he survive the original surgery with impaired competence. Annas faults the institutional review board involved for subordinating review of the ethical and legal implications of the experimental procedure to consideration of its technical aspects.
