Summary:
At its May 27, 1999 meeting, the D.C. Historic Preservation Review Board ("HPRB") granted conceptual design approval for a proposed athletic facility on the grounds of the National Cathedral School. On August 12, the National Cathedral Neighborhood Association ("Petitioner") wrote a letter to the Mayor's Agent demanding a public hearing for any construction or demolition permit issued to the National Cathedral School ("Applicant") for its proposed athletic facility. The Mayor's Agent determined that the Petitioner was without standing to demand a hearing and refused to exercise his discretion to grant such a hearing.
Mayor's Agent - Procedural:
The design review process for new construction is not a contested case matter under D.C. Code, Sec. 1-1502(8). See Dupont Circle Citizens Association v. Barry , 455 A.2d 417 (D.C. 1983). Consequently, the Petitioner is "without standing to compel the Mayor's Agent to convene an administrative hearing under the facts and status of this case." Under D.C. Code, Sec. 5-1007(e), a public hearing is required only when requested by the applicant . Without such a request, the necessity of a public hearing is within the discretion of the Mayor's Agent.
