Summary:
Applicants sought approval for the already completed installation of several vinyl-type replacement windows to their home in the Capitol Hill Historic District. The Mayor's Agent, adopting the determinations of the Historic Preservation Review Board since the Applicants failed to pursue a settlement or attend a reconvened meeting before the Mayor's Agent, concluded that the windows were incompatible with the character of the historic district, and therefore inconsistent with the purposes of the Act. He ordered their replacement with compatible windows.

The Mayor's Agent adopted the Historic Preservation Review Board's conclusion that the vinyl-style windows Applicants had installed on their home in the Capitol Hill Historic District were incompatible with the character of the historic district, and therefore inconsistent with the purposes of the Act. He therefore ordered the removal of the windows and replacement with new windows compatible with the district's character.
Mayor's Agent / Procedural:
When Applicants failed to pursue a settlement within the requisite 120 days, the Mayor's Agent issued an order to reconvene the hearing (he had granted a continuance requested by the Applicants). Applicants did not attend the meeting, despite being sent notice by mail, so the Mayor's Agent entered a default judgment against them, the effect of which adopted and reaffirmed the Historic Preservation Review Board's determination.
