Abstract
The Minnesota Court of Appeals found the county court's authorization of electroconvulsive therapy (ECT) for an unconsenting, involuntarily committed patient to be improper because it was unlimited in duration and allowed future administration of ECT whenever medical personnel determined that the patient was undergoing a relapse. The previous standard set in the highest court of the state for authorizing ECT called for present medical necessity to justify such highly intrusive treatment. Moreover, it required that the necessity for ECT be determined in an adversarial court hearing rather than unilaterally by the hospital. (KIE abstract)
