Autoři shrnují stávající legislativu, týkající se zpřístupňování historických zdravotnických záznamů, stejně jako práva a povinnosti archivů a badatelů. Interpretace je kromě jiného postavena na rozhodnutí ÚS ČR a publikovaných rozhodnutích ÚOOÚ. Zároveň věnují pozornost také těm trendům v historiografii, které usilují o větší přístup k informacím o obětech totalitních režimů 20. století, především nacismu.

The authors summarise currently valid legislation pertaining to the medical records, discuss the rights and duties of archives and researchers. Their interpretation is based, among other things, on the decision of the Constitutional Court of the Czech Republic and published opinions of the Office for Personal data Protection. They also discuss recent historiographic trends, which tend to advocate greater access to information pertaining to victims of the totalitarian regimes of twentieth century, especially Nazism.
