Abstract
Bu çalışma Türkiye’de hukuk devleti ve yargı bağımsızlığını incelemektedir. Birinci bölümde hukuk devleti ve yargı kavramları, hukuk devletinin kavramsal olarak gelişme süreci, hukuk devletinin genel özellikleri gibi konular incelenecektir. İkinci bölümde ise ilk bölümde kavramsal olarak ele alınan bu konuların anayasal süreç içerisinde ne kadarının uygulamaya geçirildiğinin değerlendirilmesi yapılacaktır. Bu bölümde hukuk devletinin ve yargı bağımsızlığının gelişim süreci anayasal olarak ayrı ayrı incelenecektir. Ve son bölüm olan üçüncü bölümümüzde öncelikle yargının bağımsızlığının mahiyeti ve diğer güçlere karşı olan duruşundan bahsedilerek akabinde yargının savunucuları ve adaletin sağlayıcıları olan hâkimlerin güvenceli olmaları konusuna değinilerek hukuk devleti kapsamında yargı bağımsızlığının ve hâkimlik teminatının ülkemiz açısından değerlendirilmesi yapılacaktır. Sonuç kısmında ise bu çalışma ışığında yargıyı güçlendirmek ve adaletin tecellisini çabuklaştırmak için neler yapılabileceği dile getirilecektir. Ülkemizdeki durum göz önüne alınarak Türkiye’de hukuk devleti ve yargı bağımsızlığı kurumlarının geliştirilmesi ve daha iyi şekilde uygulamaya koyulabilmesi adına ne yapılması gerektiği değerlendirilecektir.
This study examines the rule of law and judicial independence in Turkey. Constitutional state and concept of judiciary, conceptual development process of state of law and general characteristics of state of law will be examined in the first part. In the second part, how much of these issues, which are conceptually discussed in the first part, is put into practice in the constitutional process will be evaluated. The development process of the rule of law and the independence of the judiciary will be examined constitutionally and separately in this section. And our third chapter, firstly we will refer to status of judicial independence and stance against other forces right after we will talk about secured judges who are the defenders of the judiciary and the providers of justice and The independence of the judiciary and the guarantee of the judiciary within the scope of the rule of law will be evaluated for our country. In the conclusion, what can be done in order to strengthen the judiciary and to accelerate the manifestation of justice will be mentioned in the light of this study. Considering the situation in our country the rule of law in Turkey and the development of judicial independence on behalf of institutions and better able to put into practice what needs to be done it will be evaluated.
