The present research analyses how different theories understand the meaning of statements that purport to describe what is permitted, obligatory or prohibited in a particular legal system. It is examined, in the first place, how classical legal positivism (Kelsen; von Wright; Guastini y Alchourrón y Bulygin) understands the meaning of legal statements. Then, an original interpretation of Hart's theory, based on some elements from Wittgenstein and the philosophy of ordinary language, is proposed. It is argued that Hart's theory introduces a new approach to the theory of law that changes how we should understand the meaning of legal statements. According to that interpretation, the description of what a legal system permits, obliges or prohibits to do is always internal to the practice. In this way, this research presents an specific epistemic frame for the description of positive law, defending, as the best alternative for legal positivism, a contextualist and normative approach, sensitive to the double face of language use: in one hand, its dependence on social practices constructions and, in the other hand, the intrinsic possibility of new uses in specific contexts.

En la presente investigación se analiza cómo diversas teorías entienden el significado de los enunciados que buscan describir qué es permitido, obligatorio o prohibido según un ordenamiento jurídico particular. Se examina, en primer lugar, cómo el positivismo clásico (Kelsen; von Wright; Guastini y Alchourrón y Bulygin) entiende el significado estos enunciados jurídicos. Luego, se presenta una interpretación original de la propuesta de Hart, basada en elementos wittgenstenianos y de algunos filósofos del lenguaje ordinario, que se percibe útil para el análisis del discurso jurídico. Se argumenta que la propuesta hartiana introduce un nuevo paradigma de análisis en la teoría del derecho y cambia la forma de entender el significado de los enunciados jurídicos. Conforme a esta interpretación, la descripción de lo que un determinado sistema jurídico permite, obliga o prohíbe hacer siempre es interna a la propia práctica. De esta forma, la tesis propone un marco epistémico específico para la descripción del derecho positivo, defendiéndose, como mejor alternativa dentro del positivismo jurídico, un enfoque contextualista y normativista, sensible a la doble faz del uso del lenguaje: por un lado, su dependencia de constricciones propias de las prácticas sociales y, por el otro, la posibilidad intrínseca de nuevos usos en contextos específicos.
