The essay aims at pointing out a number of problems raised by the new article 2645 quarter of Civil Code. The first one related to the constitutionality of the regional legislation on transcription of urban constraints. The most important challenge posed by the new article concern the effectiveness of the transcription of urban constrains, if with a declarative or informational purposes. The essay claims, with formal and substantial arguments, reading of article 2645 quater of Civil Code, as a general rule that requires the transcription of urban constraints with an informational purpose. Particular attention is paid to the transcription of urban agreements.
Il saggio affronta i numerosi i profili problematici sollevati dal nuovo art. 2645 quater c.c., in primo luogo la legittimità costituzionale della disciplina regionale in materia di trascrizione, problema connesso a quello dell’efficacia ricollegabile alla trascrizione stessa. La principale difficoltà interpretativa posta dalla nuova norma riguarda proprio l’efficacia della trascrizione di vincoli e destinazioni d’uso in materia urbanistica, se dichiarativa o notiziale. Si sostiene, con argomenti di ordine formale e sostanziale, la lettura dell’art. 2645 quater c.c. come norma che prescrive in via generale l’adozione della trascrizione dei vincoli pubblici su beni immobili con funzione di pubblicità notizia. Lettura, questa, che sembra trovare conferma anche in ulteriori profili ricostruttivi inerenti alla legislazione regionale. Al riguardo, particolare attenzione viene dedicata al problema dell’efficacia della trascrizione delle convenzioni urbanistiche.
