This paper aims to analyze the evolution of the constitutional jurisprudence about the subject of "ordinarily resident", ie resident status lasted for a number of years; in order to identify the connections between the criterion of "ordinarily resident" and the possible reduction of social rights in Italy. The increase of internal migration, combined with that of international migration, in fact, is leading the local authorities (regions, municipalities) to transform the basis of residence, protracted, in a discriminating factor for welfare measures access. Therefore it is necessary to analyze how the Constitutional Court has taken into account, over the years, the need to make a balance between budgetary requirements (behind the decision to put the criteria for access to certain welfare benefits) and the need to ensure the full recognition of social rights throughout Italy, with less unevenness throughout different territories.
Questo lavoro si propone di analizzare l'evoluzione della giurisprudenza costituzionale in materia di “residenza qualificata”, ossia lo status giuridico di residente protratto per un certo numero di anni; al fine di individuare le connessioni tra il criterio di "residenza qualificata" ed una maggiore restrittività dei criteri di accesso al welfare regionale. Da un lato, l'aumento della migrazione interna, unita a quella delle migrazioni internazionali, dall’altro le esigenze di bilancio stanno inducendole istituzioni locali (regioni, comuni) a rivedere, sempre più, i criteri di accesso ad alcune prestazioni di natura previdenziale ed assistenziale, favorendo l’utilizzo della “residenza qualificata”come fattore discriminante per l'accesso misure di welfare regionale. Pertanto è necessario analizzare come la Corte costituzionale abbia tenuto conto, nel corso degli anni, della necessità di fare un equilibrio tra le esigenze di bilancio e la necessità di garantire la piena riconoscimento dei diritti sociali in tutta Italia, con meno irregolarità durante diversi territori.
