Il saggio propone i passaggi essenziali della concezione della punibilità come quarto elemento della teoria reato, con riferimento a quegli istituti ad essa ascrivibili che si limitino a determinare o escludere il verificarsi della conseguenza del fatto tipico, antigiuridico e colpevole, per l’appunto detta punibilità.
