Problems of legal policy implementation in the field of internationalization of higher legal education

Abstract

The Bologna process, globalization, national boundary-spanning necessitate the internationalization of higher legal education. However, the existing Federal educational standards (SES) for bachelor, specialist and master law programs are focused on training lawyers for the domestic legal system, as well as the training of lawyers in foreign countries is mainly aimed at the national legal system, which complicates the mutual recognition of diplomas, academic mobility and employment of our graduates in other countries. The national legal policy in the internationalization of higher legal education is not consistent either, and it has not brought the expected results. Therefore, it is necessary to determine possible solutions. Materials and methods. The empirical grounds of the research are the researchers’ experience in teaching law, including master’s programs aimed at the formation of competencies in international law. Formal-legal, comparative-legal and dialectical methods were used in the research to analyze the current educational legislation and the practice of its implementation. Results of the research. The gaps in the implementation of the policy of internationalization of higher legal education are identified. It is proved that the competences formulated SES are mainly focused on training lawyers for the Russian legal system. The absence of SES focused on training lawyers with universal competences does not allow to fully implement integrative programs.
