Abstract

�There is a familiar story told about section 75(v) of the Constitution. The story starts with the famous United States case of 'Marbury v Madison', where the Supreme Court held that it did not have jurisdiction to grant an order of mandamus directed to the Secretary of State, James Madison, to enforce the delivery of a judicial commission to William Marbury.
