Abstract:
Die Richtlinie 2001/42/EG des Europäischen Parlaments und des Rates vom 27. Juni 2001 über die Prüfung der Umweltauswirkungen bestimmter Pläne und Programme (SUP-Richtlinie) hat das Ziel, bestimmte Pläne und Programme sowie deren Änderungen in Hinblick auf die Förderung einer nachhaltigen Entwicklung einer Umweltprüfung zu unterziehen und so bereits bei der Ausarbeitung des Plans oder Programms die voraussichtlich erheblichen Umweltauswirkungen abschätzen zu können.<br />Einer der wichtigsten Anwendungsfelder der Strategischen Umweltprüfung (SUP) ist die nominelle Raumordnung. Die vorliegende Arbeit stellt zunächst die internationalen Rechtsgrundlagen zur SUP vor und beleuchtet in weiterer Folge die Umsetzung der Anforderungen der SUP-Richtlinie in die österreichische Rechtsordnung im Bereich Raumplanung. Schwerpunkt liegt dabei auf der Umsetzung in die nominelle Raumordnung der Bundesländer Oberösterreich, wo die Richtlinien-Anforderungen in das bestehende Raumordnungsgesetz integriert wurden, und Kärnten, wo ein eigenes SUP-Gesetz erlassen wurde.<br />

The "Directive 2001/42/EC on the assessment of the effects of certain plans and programmes on the environment" (SEA Directive) is a procedure that should help integrating considerations concerning environment and sustainability into strategic decision making. The SEA Directive, which was adopted by the council of the European Union in 2001, had to be translated into national law by the Member States of the European Union before 21 July 2004.<br />This paper deals with the implementation of the SEA directive in Austria, especially in the spatial planning system. After an introduction (chapter 1) the second chapter presents the legal basis of strategic environmental assessments (SEA), namely the SEA directive and UNECE Protocol on Strategic Environmental Assessment to the Convention on Environmental Impact Assessment in a Transboundary Context (SEA protocol). The following chapter explains the process of a SEA according to the SEA directive. Chapter four deals with the implementation of the SEA directive into the Austrian spatial planning system. Due to the fact that spatial planning is not a federal competence but a legislative responsibility of the Austrian federal states the SEA directive had to be transposed into each of the nine spatial planning laws of the federal states. So, after briefly introducing the Austrian spatial planning system and the measures being taken to prepare the implementation of the SEA directive the main theme of the chapter is the presentation of way the provinces amended there spatial planning laws or passed new Environmental Assessment laws in order to serve the SEA directive's demands.
