사적재산권의 불완전성에 관한 연구: 인터넷 음원 사례를 중심으로

Abstract

재산권의 주체가 명확한 재화, 즉 사적재산권이 명확하게 설정된 경우라도 권리실현이 불완전한 경우가 많다. 재산권이 성립하려면 재화의 소유, 사용, 수익, 처분에 대한 지배권이 완전해야 하지만, 현실의 재화 중 이런 요건을 완벽하게 충족하는 경우는 매우 드물기 때문이다. 이것이 사적재산권의 불완전성에 대한 연구가 필요한 이유이다. 사적재산권이 불완전하게 되는 이유는 재화로부터 얻을 수 있는 이익이 미미하기 때문이다. 이런 경우 재산권자는 재화의 가치를 적극적으로 실현할 유인이 없다. 또한 재산권의 가치를 정확하게 측정하고 재산권의 침해를 배제하는데 드는 거래비용이 높기 때문이다. 따라서 불완전한 사적재산권은 시장거래를 통해 얻는 이익이 클수록 보다 완전해 질 수 있다. 기술의 발달로 재화 가치에 대한 측정을 보다 낮은 거래비용으로 보다 정확하게 실현할 수 있게 되거나 정부에 의해 사적재산권 보호 규칙이 정해지고 이것이 엄격하게 지켜지는 경우에도 보다 완전해 질 수 있다. 본 논문은 이런 사적재산권의 불완전성의 양태, 원인, 해소 메커니즘에 대한 가설을 인터넷 음원 사례의 분석으로 입증했다. There is a lot of incompleteness in private property rights. From a theoretical perspective, private property rights means perfectly excludable rights in terms of owning, using, acquiring, and disposing of assets, but these premises are hardly met in the real world. This is why attention must be paid to the thesis of the incompleteness of private property rights. There are two causes of this incompleteness: insufficient expected gains from an asset and high transaction costs in measuring the values of assets and excluding from any untitled uses. The market should exist to alleviate this incompleteness, and in this market assets could produce sufficient values, which give owners an incentive to utilize their own assets. Measurement costs need to be as low as possible from a technological development and government should establish formal institutions for protecting private property rights from any violations.
