정부조직법 개편의 비교를 통해서 본 축적부재의 한국 대통령제

Abstract

이 글은 민주화 이후 지금까지 한국 대통령제가 안고 있는 문제 가운데 하나를 린즈가 지적한 바 있는 대통령제의 고정된 임기문제와 관련하여 축적부재의 대통령제로 규정하였다. 이러한 전제 하에서 이 글은 민주화 이후 역대 행정부의 정부조직법에 대한 비교분석을 통해서 축적부재를 야기하는 신임 대통령의 차별화의 시도가 존재하고 있는지를 검토하였다. 일반적으로 지적되어 온 대통령과 의회 간의 대립, 승자독식, 그리고 고정된 임기가 가져오는 대통령제의 문제점 이외에도, 민주화 이후의 한국 대통령제는 행정부 간 정책연속성을 저해하여 국가적인 차원에서 경쟁력을 약화시키는 축적부재의 대통령제라는 고질적인 문제를 안고 있다고 보인다. 실제로 직전 대통령 임기 중의 마지막 정부조직법과 신임 대통령의 임기 최초의 정부조직법을 비교해 보면, 새로운 행정부에 의해서 전임 행정부와의 차별화를 시도하려는 노력이 존재해 왔음을 알 수 있다. 이러한 차별화 시도는 특정 조건 하에서 더욱 강하게 나타나는 경향이 있었는데, 전반적으로 정권의 이념이 바뀌면서 정권교체가 이루어지는 경우나 혹은 정권의 이념이 바뀌지 않고 정권이 이양되는 경우라도 동일한 정당 소속신임 대통령과 전임 대통령 간의 당내 갈등이 심각했던 경우가 그러한 조건에 속한다고 추정된다. 3김시대가 종식되고 정당에 대한 장악력이 상대적으로 약화된 대선후보가 등장하여 새로운 대통령으로 당선될 때, 이러한 정치적 동기가 그 요인 가운데 하나로 작동하는 차별화의 유혹은 점점 더 커져 갈 우려가 있어 한국 대통령제의 문제로 부각될 수 있다.

This article regards the presidential politics without inter-presidential continuity as one of the gravest challenges the current Korean presidentialism faces. To explore into this endemic problem of Korean presidentialsim, this article compares the first Administrative Reorganization Acts of each of the new Administrations since the 1987 democratization with the last ones of the its immediately previous Administration. This article finds that there has been the attempts by the new president to undo, or differentiate itself from, the policies pursued by its previous president, and that the motivation would be stronger when the Administration changes took place between the parties with different political ideologies, and when there was a series of sustained intra-party feud between the outgoing president and the incoming one even within the same party.
