Jurisdiction in cases of preventive control of private construction projects in light of the environmental assessment directive
Abstract
Przedmiotem rozprawy jest przedstawienie nowego modelu jurysdykcji administracyjnej w sprawie zezwalania na realizację prywatnych przedsięwzięć budowlanych. Pojawił się on w związku z implementacją do prawa polskiego instytucji oceny oddziaływania na środowisko. Instytucja ta ustanowiona jest w dyrektywie unijnej 85/337/EWG. Wyniki oceny oddziaływania na środowisko prywatnych przedsięwzięć budowlanych uwzględniane są w prawie polskim poprzez decyzję o środowiskowych uwarunkowaniach. W odniesieniu do inwestycji wymagających oceny oddziaływania na środowisko decyzja ta jest trzecim zasadniczym aktem prewencyjnej kontroli przedsięwzięcia, obok decyzji o warunkach zabudowy i pozwolenia na budowę. W odróżnieniu od pozostałych dwóch decyzji opiera się jednak na argumentacyjnym modelu stosowania prawa. Wymagania środowiskowe zawarte w decyzji o środowiskowych uwarunkowaniach nie są wynikiem konkretyzacji wymagań ustawowych. W rezultacie w jurysdykcji administracyjnej związanej z wydawaniem decyzji o środowiskowych uwarunkowaniach stwierdzić można tzw. proceduralizację prawa. Tymczasem jurysdykcja administracyjna dotycząca decyzji o warunkach zabudowy i pozwolenia na budowę oparta jest o klasyczną formułę sylogizmu prawniczego tj. przepisy proceduralne oraz przepisy materialnoprawne zawierające wymagania wobec projektowanej inwestycji.
The subject of the thesis is presenting a new model of administrative jurisdiction concerning permits for private construction projects. The model arose in connection with implementing the institution of environmental impact assessment in Polish law, The institution was established by European Union directive 85/337/EEC. Results of environmental impact assessments of private construction projects are taken into account in Polish law by means of a decision on environmental conditions. With respect to investments which require an environmental impact assessment, such a decision is the third essential act of preventive control of the project, after the land development decision and the construction permit. Unlike these two, however, it is based on the argumentative model of applying law. Environmental requirements contained in a decision on environmental conditions are not the result of instantiation of statutory requirements. As a result, the so-called proceduralization of law can be detected in administrative jurisdiction related to issuing decisions on environmental conditions. On the other hand, administrative jurisdiction concerning land development decisions and construction permits is based on a classic legal syllogistic formula, i.e. procedural regulations and substantive regulations containing requirements as to the proposed investment.
