Legal aspects of placing the novel foods within the Union market
Abstract
Przedmiotem rozważań poczynionych w pracy doktorskiej jest zagadnienie wprowadzania nowej żywności na rynek unijny. Szczególnym wyzwaniem przed jakim staje WPR, rolnictwo i cały współczesny świat jest zapewnienie bezpieczeństwa żywnościowego w obliczu rosnącego zapotrzebowania na środki spożywcze. Rozwiązaniem problemu zwiększającego się popytu na żywność powinien być wzrost produkcji konwencjonalnej żywności, a także poszukiwanie alternatywnych źródeł pożywienia i wprowadzanie na rynek nowej żywności. Może być ona niespożywaną dotychczas w UE żywnością z państw trzecich albo wynikiem stosowania nowych sposobów produkcji lub przetwarzania. Są to jednak produkty, których bezpieczeństwo nie zostało dotychczas potwierdzone doświadczeniem bezpiecznej konsumpcji w UE. Z tego powodu może ona stanowić zagrożenie dla życia i zdrowia konsumentów w UE. Celem pracy jest próba udzielenia odpowiedzi na pytania, czy i w jakim stopniu regulacje prawne dotyczące wprowadzania do obrotu w UE nowej żywności chronią zdrowie i życie ludzi, zapewniając jednocześnie swobodny przepływ tego rodzaju żywności w UE oraz ochronę interesów ekonomicznych zarówno konsumenta, jak i podmiotu działającego na rynku spożywczym. Realizacji celu dokonano w oparciu o analizę dotychczasowych regulacji oraz tych, które będą obowiązywać od 1 stycznia 2018 r.
The aim of the doctoral dissertation is the issue of placing the novel foods within the Union market. A special challenge for the CAP, agriculture and the whole modern world is to ensure the food security in the face of growing demand for foodstuffs. The solution to the problem of the growing demand for food should be the increase of conventional food production, as well as seeking the alternative food sources and placing the novel food on the market. It might be either food from the third countries, not yet consumed in the EU or the result of implementing new production and processing methods. Notwithstanding this, these are the products which safety has not been confirmed yet by the experience of safe consumption in the EU. For this reason, it can pose a threat to the lives and health of consumers in the EU. The aim of the study is the attempt to answer the questions as whether and to what extent legislation regulating the novel foods placing in the EU, protects the health and life of people, concurrently ensuring the free movement of such food in the EU and protecting the economic interests of both the consumer and the entity acting on the food market. The study has been conducted on the basis of the analysis of actual regulations and those that will apply from January 1, 2018.
