Resumen/Abstract
RESUMEN. Cuando la familia estaba organizada con referencia a la familia nuclear y legítima, una familia fundada en el matrimonio con una fuerte división de los roles del hombre y de la mujer, las nociones de padre y madre, parecían ser suficientes. Se creó así una imagen de la familia "natural" como aquella en la que la pareja conyugal, la progenitora y la parental eran una misma realidad, dando origen a un modelo de parentesco centrado en la sexualidad/procreación y a un tipo de familia, nuclear, monógama y heterosexual. Sin embargo, los cambios en el estatuto de las mujeres, la potenciación de la voluntad individual o la evolución de la legislación y de las tecnologías, traen como consecuencia una desestabilización del modelo genealógico tradicional, lo cual nos lleva a constatar un diverso comportamiento de las personas respecto de la maternidad y paternidad cada vez más ligadas a una decisión voluntaria de asumir tal responsabilidad. La consecuencia es un derecho de filiación autónomo, que ha consagrado un nuevo campo a favor de la autonomía de la voluntad sobre la base de la estructuración del compromiso parental y no sobre la estructuración del modelo familiar.
ABSTRACT. When the family was organized with reference to the nuclear and legitimate family, a family based on marriage with a strong division of the roles between men and women, notions of father and mother seemed to be enough. It was created then an image of the "natural" family as the one in which the married couple, the progenitor and the parental couple, were the same reality; and as a result, there was a model of kinship based on sexuality/procreation, and focused on a unique kind of family: nuclear, monogamous and heterosexual. However, the changes in the status of women, the incentive of individual will or the legislative and technological developments, have made the traditional genealogical model be destabilized, and it can be noticed that there is a different behavior around maternity and paternity, because now decisions are more related to the will of taking on this responsibility. The result is an independent right of filiation, which is built on the autonomous of the will and the parental commitment, and not on the structure of a model of family.
