Resumen/Abstract
Entre las muchas decisiones judiciales de referencia elaboradas por Aurelio Desdentado se analiza una sentencia en la que se plantea si el coeficiente reductor de la edad de jubilación de un colectivo profesional debe computarse también a efectos de determinar el porcentaje aplicable a la prestación cuando la jubilación no se anticipa o no lo hace con el alcance que la norma permite. Para la nueva doctrina dictada sólo cabe computar como cotizado el período de tiempo rebajado al atribuirse cotizaciones ficticias en virtud de un trabajo que no se ha ejecutado, que no se ha retribuido y por el que no se ha cotizado, ya que, de lo contrario, se admitiría una doble cotización "la efectuada y la ficticia" sobre una misma actividad. El importe de la pensión de jubilación deberá calcularse computando únicamente el periodo en que se hubiera anticipado la edad de jubilación, de forma tal que, si nada se anticipa, nada se aplique, suponiendo una reducción en la cuantía de la jubilación en relación a las consecuencias derivadas de la jurisprudencia anterior. Revisando el criterio de la proporcionalidad, la tesis defendida por Aurelio Desdentado estima "desproporcionado" que un trabajador que cotiza y no necesita de una "cotización ficticia" se beneficie de la misma cuando accede a una edad ordinaria e incluso retrasada. Mas, al margen de la solución adoptada, cabe reseñar el manejo de la dogmática jurídica y de los principios aplicativos en la obra doctrinal, profesional y judicial de Aurelio Desdentado.
Among the many reference judicial decisions drawn up by Aurelio Desdentado, a ruling is analysed in which it is considered whether the reduction coefficient of the retirement age of a professional group should also be computed in order to determine the percentage applicable to the benefit when retirement is not early or does not do it with the scope that the regulation allows. For the new doctrine issued, the reduced period of time can only be computed as being paid by attributing fictitious contributions by virtue of a job that has not been performed, that has not been paid and which has not been contributed to, because otherwise a double contribution would be admitted - the one made and the fictitious one - on the same activity. The amount of the retirement pension must be calculated by computing only the period in which the retirement age was brought forward, so that, if it is not early, nothing is applied, assuming a reduction in the amount of retirement in relation to the consequences derived from previous jurisprudence. Reviewing the criterion of proportionality, the thesis defended by Aurelio Desdentado considers it "disproportionate" that a worker who contributes and does not need a "fictitious contribution" benefits from this when they reach an ordinary and even delayed age. But, regardless of the solution adopted, it is worth mentioning the handling of legal dogmatics and applicative principles in the doctrinal, professional and judicial work of Aurelio Desdentado.
