Abstract
Çalışmamızın konusu 5846 S. Fikir ve Sanat Eserleri Kanunu md. 18/2'de düzenlendiği çerçevede çalışanların meydana getirdiği eserler üzerindeki fikri haklardır. Bu kapsamda hükmün Türk hukukundaki tarihçesi, uluslararası hukuklarda yer alan benzer hükümler, hükmün uygulanabilmesinin şartları, hükmün kapsamı, hükmün nitelendirilmesi ve FSEK'in diğer hükümlerinin FSEK md. 18/2 ile birlikte uygulanması incelenmiştir. Ayrıca uygulamada karşılaşabilecek bir takım sorunlar ve çözüm önerileri ve Kanunda yapılması gereken değişiklikler hakkında öneriler ortaya konulmuştur.
The subject of our study is copyrights on works created by employees within the framework article 18/2 of the Turkish Copyright Act No. 5846. In this context the history of the article in Turkish law, similar provisions of international law, the scope of the article, the qualification of the article, conditions for implementation of the article and implementation of the article with the other articles in Copyright Act have been examined. Besides, some issues that may be encountered in practice and solution suggestions to those issues and ammendment recommendations need to be revised in Copyright Act have been introduced.
