Dos efeitos da Procriação Medicamente Assistida no Direito Sucessório

Abstract

A Procriação Medicamente Assistida, enquanto tema de estudo, implica alguma polémica, principalmente no que respeita às questões jurídicas que a envolve. Porém, é um tema pouco estudado e que merece a inversão desse facto. Acontece que a legislação portuguesa em torno desta matéria, nomeadamente no que respeita aos efeitos sucessórios, é um pouco omissa. Tentaremos clarificar tais omissões. É notório que ao longo dos anos a aceitação da Procriação Medicamente Assistida no âmbito social e jurídico tem sido crescente, sendo certo que o Direito tem acompanhado a ciência. Em suma, condensaremos o objeto da investigação a desenvolver, no âmbito da elaboração de dissertação de mestrado, no desígnio de encontrar as respostas possíveis para as seguintes questões: quais os efeitos sucessórios que a Procriação Medicamente Assistida reproduz no Ordenamento Jurídico português? Como se processam tais efeitos? Quais as consequências que acarretam? Com tais questões pretendemos perceber se o nosso Ordenamento Jurídico está preparado para responder de forma atual e conveniente a estas questões, tendo como foco o direito sucessório. Neste seguimento, torna-se oportuno abordar a questão da Inseminação Artificial post-mortem, sabendo que esta é uma técnica que utiliza os espermatozoides ou embrião conservado, por meio de técnicas especiais, após a morte do doador. Tendo em atenção esta definição, como serão resolvidas as questões relativas aos efeitos sucessórios de uma criança nascida através desta técnica é algo que será alvo de análise. Ultimamente, Portugal tem verificado um acréscimo de discussões sobre os métodos de tratamento da esterilidade e sobre as novas técnicas de procriação assistida, principalmente porque já nasceram crianças graças à Fertilização in vitro. Pretendemos constatar qual a inclinação que o Direito manifesta no que concerne a estas questões: como regula, admissibilidade, quais as tendências e consequências. Estará o Direito a responder de forma atual a uma questão polémica existente há vários anos? Só depois disto, estaremos em condições de proceder ao estudo da Procriação Medicamente Assistida no âmbito do Direito das Sucessões, percebendo as suas implicações para o casal e para o Direito, analisando a questão de uma perspetiva jurídica e brevemente bioética. Espera-se clarificar deste modo o efetivo alcance dos efeitos sucessórios no que concerne à Procriação Medicamente Assistida.

The Medically Assisted Procreation, as an educational theme, involves some controversy, mainly regarding the issues that surrounds it. However, is a little studied topic and it deserves the reversal thereof. It turns out that the Portuguese legislation surrounding this matter, particularly with regarding the inheritance effects, is somewhat silent. We try to clarify such omissions. It is clear that over the years the acceptance of Medically Assisted Procreation in both social and legal framework has been growing, given that the law has followed science. In short, the investigation object to develop, in this master thesis in order to find the possible answers to the following questions: what are the succession effects the Medically Assisted Procreation has in the Portuguese legal system? How to handle these effects? What are the consequences they entail? With these questions we intend to understand whether our legal system is ready to respond expectations, focusing on the law of successions. Following this, it is appropriate to address the issue of Post-Mortem Artificial Insemination, knowing that this is a technique that uses sperm or embryo conserved through special techniques, after the death of the donor. Taking into account this definition, such issues will be resolved to succession effects of a child born through this technique is something that will be studied further. Lately, Portugal has been a discussion on the rise of infertility treatment methods and the new assisted reproduction techniques, mainly because children have been born thanks to IVF. Which we intend to realize the slope that the law manifests in relation to these issues: how to regulate, admissibility, Trends and consequences. Is the right to respond in order to present a contentious issue which has existed for several years? Only after this we will be able to proceed to the study of Medically Assisted Procreation under the Law of Succession, realizing its implications for the couple and for the law, examining the question of a legal and briefly bioethical perspective. Expected to be clarified so the effective range of the succession effects regarding the Medically Assisted Procreation.
