As a part of the results obtained from the international collaboration led by the author to develop an Asian standard of the basic law on post-disaster recovery, this paper focus on the issues of compensation for the loss incurred to the disaster-affected people and communities as the result of land-expropriation and other restrictions in the course of post-disaster reconstruction projects for town-recovery and infrastructure rebuilding. Although it is an established constitutional principle in many countries that none of governmental projects for public use is allowed to expropriate civil properties without fair compensation, government-led post-recovery projects are often considered as “support” given by discretions of the government rather than a “public use” which necessitates obligatory compensations. The author’s fieldwork in the areas hit by the 2011 East Japan Earthquake & Tsunami has identified typical situations where government-led post-recovery projects save compensations for the civil rights which are in particularly weak positions, including small ownerships of tsunami-affected farming lands, land leaseholders lacking formal registrations, communal land orders based on traditions, fishery rights linked to such customary orders, etc., all of which constituting indispensable bases of livelihood of disaster-affected people and communities. Similar phenomena are observed in other disaster-prone areas in Asia, according to the recent series of fieldwork conduced by the authors’ group, including the visits to the villages in and outskirts of Banda Aceh in Indonesia hit by the 2004 Indian Ocean Tsunami, the villages in Pangna province in Southern Thailand affected in the same Tsunami, the villages in Beichuan area which was most seriously destroyed by the 2008 Sichuan Earthquake in China, and the villages in Leyte and Samar islands hit by the 2013 Typhoon Yolanda in the Philippines. In order to achieve the ideal of “human-centered recovery” as emphasized in the post-Hanshin Awaji Earthquake context and recently reinstated as “early recovery,” this paper emphasizes the needs for the basic law to oblige the government to reconsider the status quo of the pre-disaster civil and communal properties, to differentiate the support and the compensation, and to strengthen the judicial access to activate its supervisory function for the good governance of post-disaster recovery.
