The work examines the European Court of Justice’s and the European national Courts’ decisions in relation to the use of a third-party trademark in the keyword advertising service provided by the main search engine operators. The decisions issued by the European Court of Justice - besides giving preliminary rulings concerning the interpretation of the EU trademark law in order to assess the lawfulness of the use of a third-party trademark in the most popular behavioural advertising on the Internet - give the chance to analyse the ECJ’s case law regarding the elements which constitute an infringement of the trademark. The main focus are on (i) the definition of “use in commerce” and “in relation to products and services”, (ii) the eligibility requirements for enjoying the protection provided by Art. 5, n. 1, lett. a) of the Trademarks Directive (double identity provision), and (iii) the existence (and eligibility for protection) of trademark functions other than the “essential” function, which is to guarantee to consumers the origin of the goods or services. The last part of the work, analyses the decisions of the main European national Courts issued after the ECJ’s preliminary rulings.

Abstract
