Resumen
La exigencia de motivación de las Sentencias está directamente relacionada con
los principios de un Estado de Derecho (art. 1.1 C.E.) y con el carácter vinculante que
para los Jueces y Magistrados tiene la Ley, a cuyo imperio están sometidos en el
ejercicio de su potestad jurisdiccional (art. 117 C.E.).

La exigencia de motivación de las Sentencias está directamente relacionada con
los principios de un Estado de Derecho (art. 1.1 C.E.) y con el carácter vinculante que
para los Jueces y Magistrados tiene la Ley, a cuyo imperio están sometidos en el
ejercicio de su potestad jurisdiccional (art. 117 C.E.).
La motivación de las resoluciones judiciales requiere dar cuenta comprensible de
la razones que tenga el juez para justificar su decisión. Potencia la seguridad jurídica,
permite a las partes en el proceso conocer y convencerse de la corrección y justicia de la
decisión y garantiza la posibilidad de control de la resolución por los Tribunales
superiores mediante los recursos que procedan, incluido el de amparo.
Tanto el Tribunal Constitucional como el Tribunal Supremo se han pronunciado
al respecto dando lugar a una abundante jurisprudencia. A la interpretación llevada

The requirement to state the reasons for the Judgments is directly related to the
principles of a Rule of Law (Article 1.1 EC) and to the binding nature of said law by
Judges and Magistrates to which they are subject in the exercise of their jurisdictional
power (Article 117 EC).
The arguments in judicial decisions require a clear account of the reasons
justifying the courts´decision. This strengthens legal safeguards, allows the parties
involved in the process to know and be convinced of the correctness and justice of the

decisión and guarantees the possibility of control of the resolution by the higher courts
through appropiate remedies, including seeking legal refuge under the law.
Both the Constitutional Court and the Supreme Court have ruled in this regard,
giving rise to a wealth of jurisprudence. Added to the interpretation carried out by our
