Abstract
La Libertad de Expresión se constituye como uno de los derechos fundamentales más
importantes dentro de un sistema democrático. Sin él, la vida tal y como la concebimos hoy
en día carecería de sentido. Pero este significativo derecho también encuentra sus límites,
siendo estos los derechos ajenos y el discurso de odio. Actualmente podemos encontrar
múltiples situaciones en las que hallamos conflictos entre el derecho a la libertad de
expresión y otros derechos fundamentales. Muchos son los casos que tratan esta
problemática, pero no pueden ser estudiados todos. Así, de entre todos ellos he elegido
aquellos que considero que aportan una mayor información al campo de investigación sobre
la libertad de expresión. Con los seleccionados mi única intención ha sido realizar un
exhaustivo análisis sobre los límites de este derecho y cómo estos límites han apodido
ayudar al progreso de los límites jurídicos y de la sociedad. Se trata de una tarea que no
habría sido capaz de desarrollar sin la ayuda de la jurisprudencia del Tribunal Europeo de
Derechos Humanos y las múltiples sentencias y comentarios existentes sobre estos asuntos. The Freedom of Speech is understood as one of the most important fundamental rights on a
democratic system. Without it, life such as we conceived it nowadays would be pointless.
But this significant right has also its limits, one of these being the rights of other people and
the hate speech. At the present time we can find a lot of situations where we find conflicts
between the freedom of speech and other fundamental rights. There are lots of cases that
debate this trouble, but not all of them can be studied. Among all of them, I have chosen
those which I consider that give us more information in the investigation field about
freedom of speech. With the chosen ones my only desire has been carry out an exhaustive
analysis about the limits of this right and how these limits could have affected to help the
progress of the legal limits and the society. It is a task I could not have been able to develop
without the help of the jurisprudence of the European Court of Human Rights and the
multiple verdicts and opinions about these matters.
