Beyond the football field

Abstract

O mundial de futebol da FIFA no Qatar resultou num substancial fluxo migratório de trabalhadores necessários para as preparações deste evento, principalmente na construção de infraestruturas. Estes encontraram-se num cenário de escravidão proporcionado pelo recentemente abolido Sistema Kafala, e as suas deploráveis condições de vida e de trabalho rapidamente mancharam a competição. Para compreender o quadro jurídico nacional e internacional em torno do envolvimento da FIFA nas violações dos direitos humanos no Qatar, esta dissertação primeiramente apresenta a realidade destes trabalhadores no Qatar e posteriormente examina a estrutura organizacional da FIFA. É também investigado o modo como a FIFA reconheceu a sua responsabilidade, o seu âmbito e outras alternativas para a responsabilizar. Os resultados deste reconhecimento são então avaliados, especialmente a adoção da Política de Direitos Humanos e de o processo de concurso revisto para selecionar o país anfitrião do Mundial, bem como os efeitos destas mudanças internas sobre os próprios trabalhadores. Apesar dos esforços para proteger os trabalhadores envolvidos na construção ou prestação de serviços e das recentes reformas da legislação laboral, a sua atual situação continua a ser lamentável. Finalmente, a posição da FIFA, que contribuiu para o desenvolvimento da área de “empresas e direitos humanos” e da Lex Sportiva ao dar prioridade à proteção dos direitos humanos nas suas políticas internas, foi insuficiente para a situação em concreto. No entanto, poderá auxiliar na prevenção de eventos semelhantes no futuro ou servir como base jurídica para decisões judiciais, oferecendo às potenciais vítimas um acesso a recursos legais.

The FIFA World Cup was recently held in Qatar, resulting in a substantial influx of workers who left their homelands in the previous decade to work on event preparations, mainly infrastructure construction. These migrant workers found themselves in a slaverylike scenario enabled by the recently abolished Kafala System, and their deplorable living and working conditions rapidly stained the event. To make the domestic and international legal framework surrounding FIFA's involvement in human rights violations in Qatar clearer to understand, this dissertation first illustrates the reality of these workers in Qatar before examining FIFA's organizational structure. Additionally, the process through which FIFA acknowledged responsibility, its scope, and other alternatives for holding FIFA responsible are investigated. The outcomes of this acknowledgement of responsibility are then evaluated, particularly the adoption of a Human Rights Policy and a revised bidding process to select the World Cup host country, as well as its actual effects on migrant workers in Qatar, which demonstrate that, despite efforts to protect workers engaged in site construction or service provision and recent labour law reforms, the situation of migrant workers in this country remains appalling. Finally, FIFA's position, which contributed to the development of Business and Human Rights and Lex Sportiva by prioritizing human rights protection in its internal policies, was insufficient to solve this specific situation. Nevertheless, it may aid in the prevention of similar events in the future or serve as a legal foundation for court rulings by giving potential victims with access to legal remedies.
