O incumprimento no crédito à habitação e a diminuição do risco na entrega da casa

Abstract

Mortgage lending is of particular relevance in Portugal, not only at a social level, as it represents the main source of indebtedness of Portuguese households, but also at the level of the financial sector, with a significant weight in credit institutions’ balance sheets. This dissertation focuses on its credit default and on the foreclosure mechanisms available to credit institutions for debt repayment (even after the delivery of the relevant mortgaged real estate) and analyzes the current solutions aiming at the mitigation of the risks associated with this type of credit, presenting alternative solutions that could be effective in reducing the aforementioned risk.

O crédito à habitação hipotecário reveste-se de particular relevância em Portugal, não apenas ao nível social, ao constituir a principal fonte de endividamento das famílias portuguesas, mas também ao nível do setor financeiro, tendo um peso relevante nos balanços das instituições de crédito. A presente dissertação debruça-se sobre o incumprimento nesta modalidade de crédito e sobre os mecanismos executivos ao dispor das instituições de crédito para satisfação da dívida (mesmo após a entrega da casa por parte do mutuário) e analisa as soluções em vigor que visam mitigar os riscos associados a este tipo de crédito tanto para mutuante como para mutuário, apresentando soluções alternativas que poderiam ser eficazes na diminuição do risco.
