Ética e códigos de conduta na Administração Autárquica Portuguesa

Abstract

Sendo a ética na Administração Pública um tema atual no contexto académico, político e social, quer na esfera nacional (e.g. Bilhim et al., 2015; Correia et al., 2019; Gilman, 2005; Giovanola, 2011; Hondeghem, 1988; Maia et al., 2020; Svara et al., 2015; Wechsler, 2013) este estudo teve como principal objetivo perceber se tal como recomendado pelo Conselho de Prevenção da Corrupção (CPC), os Municípios implementaram códigos de ética e de conduta, a razão da sua implementação e se a partir da sua adoção se tornaram visíveis alterações ao nível dos comportamentos dos seus colaboradores. Aborda também a importância das ações de formação sobre ética, e a transmissão de valores e princípios éticos. Por último verificar se está disponível e acessível o Plano de Prevenção de Riscos de Corrupção e Infrações Conexas (PGRCIC). Por forma a atingir o presente objetivo foram enviados questionários às várias autarquias de Portugal. A presente dissertação contou com a participação total de 157 municípios num total de 308 municípios. Os resultados obtidos referem que os Municípios que têm códigos de ética ou de conduta e que efetuaram a sua monitorização relativamente a alterações comportamentais dos seus colaboradores reconheceram o impacto positivo da sua implementação. Constatou-se que cerca de metade dos Municípios têm um código de ética disponível no seu site e, muito embora as recomendações do CPC, a existência do PGRCIC não se encontra totalmente adotada e dos que o incluem de forma transparente no seu site cerca de metade não apresenta monitorizações regulares.

Ethics in public administration is a current theme in the academic, political and social context, whether in the national or international sphere (e.g. Bilhim et al., 2015; Correia et al., 2019; Gilman, 2005; Giovanola, 2011; Hondeghem, 1988; Maia et al., 2020; Svara et al., 2015; Wechsler, 2013) this is why this study aimed to understand, as recommended by the Council for the Prevention of Corruption (CPC), whether: (a) the municipalities implemented codes of ethics and conduct, (b) why they implemented them, and (c) whether changes in the behavior of their employees became visible from their adoption. It also addresses the importance of training actions on ethics, and the transmission of ethical values and principles. Finally, we intended to check whether the Plan for the prevention of risks of corruption and related infractions (PGRCIC) was available and accessible. In order to achieve this objective, questionnaires were sent to the various municipalities in Portugal. This dissertation had the total participation of 157 municipalities in a total of 308. The results obtained show that the municipalities that have codes of ethics or codes of conduct and that have monitored them with regard to the behavioral changes of their employees have recognized the positive impact of their implementation. It was found that about half of the Municipalities have a code of ethics available on their website and, despite the recommendations of the CPC, the existence of the PGRCIC is not fully adopted and of those that include it transparently on their website, about half do not present regular monitoring.
