Análise à luz do direito do posicionamento do Reino Unido relativamente à Europa

Abstract

Winston Churchill referiu, em 1963, aquando do primeiro pedido de adesão, que «o futuro da Europa sem o Reino Unido [seria] realmente negro.» Hoje, mais de 60 anos após o seu estabelecimento, a União Europeia encontra-se em negociações para a primeira saída de um Estado-membro. Como tal, considerou-se relevante fazer uma retrospetiva, desde o pós-II Guerra Mundial até aos dias de hoje, abordando os momentos cruciais que definiram esta relação e os passos que estão a decorrer para estabelecer uma nova. Com este fim, debruçámo-nos sobre o afastamento das ideias de integração europeia; as implicações de aderir à União; a relutância em aceitar os valores europeus, a nova ordem jurídica supranacional e consequente evolução do conceito de soberania; a flexibilidade da União Europeia em aceitar uma integração diferenciada da qual o Reino Unido beneficiou de cinco opt-outs e as renegociações britânicas, das quais uma culminou no referendo de 2016 que ditou a saída. A partir daqui debatemo-nos com o processo de retirada, nomeadamente a interpretação do artigo 50.º TUE, as implicações de sair e as negociações até hoje realizadas, finalizando com o impacto na União Europeia. Concluiu-se que a premissa da sua relação com a União era evitar qualquer limitação à sua soberania e obter os benefícios possíveis. O Reino Unido era o Estado-Membro menos empenhado e integrado na União, por escolha própria; ambos se moldaram para estabelecer a melhor relação possível, mas os britânicos deixaram de ver a União como a melhor forma de prosseguir os seus interesses nacionais; e por fim, as possibilidades que tal saída apresenta: o Reino Unido tornar-se-á pleno soberano, como sempre desejou ser, e a União tem porta aberta para prosseguir a ideia de uma união cada vez mais estreita dos povos.

Winston Churchill mentioned at the time of the first application for membership, in 1963, that ‘the future of Europe if Britain were to be excluded [would be] black indeed.’ Today, more than 60 years after its establishment, the European Union is in negotiations for the first withdrawal of a Member State. As such, it was found relevant to take a retrospective, from post-World War II to the present day, addressing the crucial moments that defined this relationship and the steps that are being taken to establish a new one. To this end, we have focused on the dissociation from the ideas of European integration; the implications of joining the Union; the reluctance to accept the European values, the new supranational legal order and consequent evolution of the concept of sovereignty; the European Union’s flexibility to accept differentiated integration from which the United Kingdom benefited of five opt-outs and the British renegotiations, one of which culminated in the 2016 referendum resulting in the withdrawal decision. From here on, we debated the withdrawal process, namely the interpretation of Article 50 TEU, the implications of leaving and the negotiations to date, ending with the impact on the European Union. It was concluded that the premise of its relationship with the Union was to avoid any limitation on its sovereignty and to obtain the possible benefits. The United Kingdom was the least committed and integrated Member State of the Union, by choice; both shaped themselves to establish the best possible relationship, but the British no longer saw the Union as the best way to pursue their national interests; and finally, the possibilities that such withdrawal presents: The United Kingdom will become full sovereign, as it has always desired to be, and the Union has an open door to pursue the idea of an ever closer union among the peoples.
