La reforma penal de 2015: La financiación ilegal de partidos políticos.

Abstract

En este trabajo se analiza la reforma del Código Penal operada por la Ley Orgánica 1/2015 y, más concretamente, el nuevo delito introducido por la misma de financiación ilegal de partidos políticos.

La configuración de este nuevo delito era hasta ahora inexistente en nuestro país y en este trabajo se intentará, de una forma aproximada, realizar un estudio crítico acerca del contenido de esta nueva figura. Así se valorarán los antecedentes que han llevado a la tipificación de la nueva conducta punible, la normativa nacional e internacional aplicable, las motivaciones de los partidos políticos para recurrir a la financiación ilegal, se realizará un análisis crítico de las disposiciones y un breve recorrido por la responsabilidad penal de los partidos políticos.

The purpose of this paper is to review the reform operated by the Organic Law 1/2015 and, more specifically, the new offense: illegal funding of political parties. The configuration of this new offense didn’t exists in our country and in this paper we will attempt to make a critical study of the content of this new figure. So the background that led to the definition of the new criminal offense, national and international rules and the motivations of political parties to resort to illegal funding will be valued in this paper. Furthermore, in this paper we will make a critical analysis of the provisions and a brief tour will be conducted by criminal responsibility of political parties.
