The Court held that the FOIA request for unredacted reports relating to the investigation into Russian interference with the 2016 election was properly withheld under Exemption 5. 487 F. Supp. 3d at 20. Note that on Oct. 16, 2020, Judge Walton issued an order requiring the DOJ to file a declaration by the President or an individual that conferred directly with the President regarding whether the President’s Oct. 6, 2020 was intended to order the declassification and release of unredacted versions of the reports.
