Abstract:
Although at first sight stress seems to be an essentially negative phenomenon it is, as Selye
puts it, ‘the spice of life’. We could not live without stress. On the one hand we can talk about
eustress, if we are be able to cope with stress. On the other hand exists distress, if we are
frustrated. The first part of study looks at work-related stress, which is special kind of the
stress and considered as a psychosocial risk. In the context of work-related stress it is worth
reviewing the EU regulations, the Hungarian legislation, as well as the results of related
surveys and the EU-OSHA’s guidance. The other part of study aims to present stress-related
lawsuits, which are divided into four types. After general remarks on stress-related trials,
three stress-lawsuits are analysed in more details. In my view, the employees are in a difficult
situation when it comes to proving that work-related stress has caused them damage.
