| Resumo: | O presente estudo trata das relações entre processo e direito material, com ênfase na ação e na classificação das suas eficácias. Inicialmente, aborda a concepção unitária e dualista do ordenamento jurídico, optando pela teoria dualista, mas propondo a relativização da dicotomia entre as concepções. Examina a natureza jurídica do processo para compreendê-lo na perspectiva de uma relação jurídica e de um procedimento em contraditório. Compreende a finalidade do processo como a realização do direito objetivo, pacificação social e a efetiva realização do direito material no caso concreto, em busca de justiça, essa de caráter procedimental e interpretativo. Trata, ainda, do direito fundamental à efetividade do processo. Consideradas tais premissas, apresenta às teorias da ação, as criticas endereçadas a cada uma das teorias e analisa em que medida as teorias se complementam. Em especial, trata da polêmica em torno da utilidade do conceito de pretensão e ação material, concluindo pela utilidade dos conceitos. Refere à perspectiva constitucional da ação e da tutela jurídica. Considera que o critério de classificação das ações, sentenças, tutelas ou demandas ostenta caráter processual e consulta ao direito material. A classificação que melhor corresponde ao fenômeno é a que compreende as cinco eficácias: declaração, constituição, condenação, mandamento e execução. O trabalho aborda as diversas questões com o objetivo de contribuir ao estreitamento das relações entre o processo e o direito material, na perspectiva da efetividade.
The present study deals with the relationship between the Procedure and substantive Law, with emphasis in the action and classification of its forces. To start with, it tackles the unitary and dualist conception of the legal system, choosing the dualist theory, however proposing the relativity of the dichotomy between the conceptions. It scrutinizes the Juridical Nature of the Procedure to understand it in the perspective of the juridical nature and of a contradictory procedure. It comprises the intent of the procedure as the realization of objective law, social conciliation and the effective realization of substantive law in a concrete case, in the search for justice, this of a procedural and interpretive character. It still deals with the fundamental right to effectiveness of the procedure. Considered such premises, it presents the theory of actions, the criticism addressed to each theory and analyses to what extent they complement one another. In special, it deals with the polemics in relation to the usefulness of the pretension repute and material action, concluded by the usefulness of concepts. It refers to the constitutional perspective of action and of the juridical tutelage. It considers that the classification criterion of Actions, Decisions, tutelages or demands shows a procedural character and consultation to substantive law. The classification that best corresponds to the phenomenon is the one that encompasses the five efficacies: declaration, constitution, conviction, mandate and execution. The work approaches several questions with the objective of contributing to the narrowing of the relations between the procedure and the substantive law, in the effectiveness perspective. |
