Resumo
Essa pesquisa tem como objetivo analisar as formas de interações entre os movimentos sociais, organizações da sociedade civil e a Justiça, no sentido da mobilização do direito, por meio da litigância estratégica. O estudo investiga os sentidos que constroem as garantias dos direitos da mulher, buscando responder se a mobilização do direito e, por conseguinte, a litigância estratégica, constituem um meio para se obter avanços na questão dos direitos das mulheres. Para isso, são apresentados levantamentos quantitativos e qualitativos, a partir da literatura existente sobre objetos científicos de litígio estratégico e da mobilização do direito, e das principais entidades que têm atuado nos últimos cinco anos (2015-2020) em relação ao tema. É feita uma análise dos julgados do STF para delimitar quais e como entidades se utilizam dessa forma jurídica de litígio. Também será analisada a correlação entre demandas estratégicas que estimulam a mobilização do direito e sua eventual incorporação na agenda política, por meio de análise documental de implantações de políticas públicas em nível federal. Ao final da pesquisa, espera-se contribuir com a expansão do estudo da mobilização do Direito na sociedade brasileira, atualizando os dados sobre como a mobilização do direito impacta na criação e manutenção de políticas públicas, como forma de garantir os direitos das mulheres.
This research aims to analyze the forms of interaction between social movements, civil society organizations, and the Judiciary in the sense of mobilizing the law through strategic litigation. The study investigates the meanings that construct the guarantees of women's rights, seeking to answer whether the mobilization of the law and, consequently, strategic litigation, constitute a means to obtain advances in the issue of women's rights. To this end, quantitative and qualitative surveys are presented, based on the existing literature on the scientific objects of strategic litigation and the mobilization of law, and the main entities that have been active in the last five years (2015-2020) on the subject. An analysis is made of the judgments of the STF to delimit which and how entities use this legal form of litigation. The correlation between strategic demands that stimulate the mobilization of the law and its eventual incorporation into the political agenda will also be analyzed through a documentary analysis of public policy implementations at the federal level. At the end of the research, we hope to contribute to the expansion of the study of the mobilization of law in Brazilian society, updating the data on how the mobilization of law impacts the creation and maintenance of public policies, as a way to guarantee women's rights.
