Abstract:	Com recurso à teoria marxiana e lukacsiana, tratar-se-á da teoria de Hans Kelsen mostrando como ela remete a importantes questões metodológicas as quais, com recurso a um pensamento antinômico, ao final expressam uma posição concreta frente à realidade. Ela, em verdade, não pode ser acusada de desconsiderar a influência política e ideológica na conformação real e efetiva do Direito; simultaneamente, porém, traz, mesmo ao adotar uma postura normativista, certo realismo e voluntarismo, que acreditam ser possível ao Direito ser meio para qualquer conteúdo social.
Abstract:	Recurring to Lukács and Marx, we intend to deal with Hans Kelsen´s theory, which is incomprehensible without his method. This method leads to antinomies that – we intend to shoe – express a concrete attitude towards reality. The author cannot be accused of underestimate the influence of ideology and politics on Law; although, simultaneously, it brings certain realism and voluntarism, which is believed Law can be an instrument to any social content.
