Abstract
[Resumen] La idea de que los servidores públicos y los sistemas orgánicos públicos, estatales
y no estatales, están obligados a poner a disposición de los ciudadanos, de la forma más
amplia posible, determinada información que se considera relevante para el control social, la
participación de la vida democrática y la rendición de cuentas, ha ganado un gran impulso
a nivel internacional.
A través de esta exposición, trataremos de analizar el fundamento del derecho de acceso
a la información pública, las soluciones en el derecho comparado, el régimen legal y
reglamentario vigente en el Uruguay, las obligaciones de las personas públicas estatales y no
estatales, el órgano de control y sus dictámenes, y los primeros pronunciamientos judiciales
en la materia.
Nos toca vivir en una Administración Pública en la era del Gobierno Electrónico (e-Gov),
donde resulta inimaginable pensar en una gestión pública sin transparencia, sin que los
ciudadanos pueden acceder y conocer información relevante y verdaderamente significante,
propia de la función pública, del manejo de los fondos públicos, de ahí que vale resaltar el
valor de lo que debemos entender como rendición de cuentas democrática
[Abstract] The idea that public servants and public organ systems, and non-state, are required to make available to citizens, as widely as possible, certain information that is considered relevant for social control, participation of democratic life and accountability, has gained momentum internationally. Through this exhibition, we try to analyze the basis of the right of access to public information, the solutions in comparative law, legal and regulatory regime in force in Uurguay, the obligations of public figures and non-state, the national control and their opinions, and early judicial pronouncements on the subject. We live in a public administration in the era of electronic government (e-Gov), where it is unimaginable to think of a governance without transparency, without which citizens can access and find relevant information and truly significant, characteristic of the civil service management of public funds, hence it is worth highlighting the value of what we understand as democratic accountability
