Resumo(s): | O estudo do regime de bens toca um dos aspetos mais relevantes do regime jurídico
patrimonial do casamento: por um lado, pelos efeitos pessoais e patrimoniais que a escolha do regime
implica e, por outro lado, por assentar num conjunto de regras que define a propriedade sobre os bens
dos cônjuges, determinando o património próprio e comum de cada um deles.
A faculdade de optar por um determinado regime de bens, mediante a celebração de
convenção antenupcial, ou, mediante o silêncio dos nubentes, pelo regime supletivo ou imperativo é
concedida pelo princípio da autonomia da vontade. Além do princípio da autonomia da vontade, dois
outros princípios coexistem como princípios do regime de bens e da convenção antenupcial, a saber:
imutabilidade e liberdade.
O princípio da imutabilidade estabelece a proibição de os cônjuges alterarem quer o regime de
bens, quer a convenção antenupcial, impedindo, assim, que os cônjuges na vigência do matrimónio
adequem a sua situação patrimonial à sua situação familiar atual. Sendo um dos principais motivos, da
sua permanência no ordenamento jurídico português, a proteção de terceiros credores.
Na verdade, é na constância do casamento que a busca do melhor interesse familiar pode
incentivar à alteração do regime de bens. Todo o direito ao atribuir liberdade estabelece limites a essa
liberdade, porém é preciso proporcionar um espaço à liberdade dos cônjuges para que possam
projetar de acordo com as suas vontades as suas relações matrimoniais, acautelando, contudo, os
direitos de terceiros. Conceder uma ampla vontade aos terceiros, não significa que os interesses dos
mesmos devam prevalecer sobre os interesses familiares, há que encontrar um ponto de equilíbrio
entre os interesses de terceiros e os interesses da família.
Assim, para abolir o princípio da imutabilidade e inovar para o princípio da mutabilidade
precisamos de encontrar mecanismos de defesa e proteção para os direitos adquiridos por terceiros
em momento anterior à modificação do regime de bens. The study of the property regime touches one of the most relevant aspects of the marriage's patrimonial legal regime: on the one hand, the personal and patrimonial effects that the choice of the regime implies and, on the other hand, by laying on a set of rules that define the property of the spouses, determining their own common assets. The option of choosing a particular system of property by means of a prenuptial agreement or, considering the silence of the couple, by the supplementary or imperative regime is granted by the principle of autonomy of will. Besides the principle of autonomy of will, two other principles coexist as principles of the regime of goods and the prenuptial agreement, namely, immutability and freedom. The principle of immutability establishes the prohibition on the spouses from altering both the property regime and the premarital convention, thereby preventing spouses during marriage from adjusting their property situation to their current family situation. Being one of the main reason for its permanence in the Portuguese legal system, the protection of third party creditors. Indeed, it is in the constancy of marriage that the pursuit of the best family interest can encourage the change in the property regime. Every right to grant freedom sets limits to that freedom, but there must be room for the freedom of the spouses so that they can design their marital relations according to their wishes, while safeguarding the rights of third parties. Granting a broad will to third parties does not mean that their interests should take precedence over family interests; a balance must be struck between the interests of others and those of the family. Thus, in order to abolish the principle of immutability and innovate to the principle of mutability we need to find mechanisms for the defense and protection of rights acquired by third parties prior to the modification of the property regime. |
